Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ThinkwithAD publication on Substack (the “Service”). By accessing or using the Service, you agree to these Terms.

1) Who we are

ThinkwithAD (“we,” “us,” “our”) is a publication focused on entrepreneurship, strategy, and creative execution. The Service is hosted by Substack, Inc. Your use is also subject to Substack’s own terms, privacy policy, and payment rules.

2) Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent you have authority to bind that organization to these Terms.

3) Accounts & Subscriptions

  • Some features require an email subscription or a paid plan.

  • Billing, renewals, and cancellations are processed by Substack/Stripe and governed by their policies.

You are responsible for safeguarding your account credentials and for all activity under your account.

4) Acceptable Use

You agree not to:

  • Violate any laws, third-party rights, or these Terms.

  • Post or transmit hateful, harassing, defamatory, fraudulent, obscene, or otherwise unlawful content.

  • Attempt to scrape, copy at scale, reverse engineer, or interfere with the Service’s normal operation.

  • Use the Service to distribute spam or unauthorized advertising.

We may moderate, remove, or restrict content or accounts that violate these Terms.

5) User Content & License

If you post comments or other content (“User Content”), you retain ownership of your rights. You grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your User Content in connection with the Service and for promotional purposes.

You represent that your User Content does not infringe others’ rights and that you have all necessary permissions to grant the above license.

6) Our Content & IP

All articles, graphics, branding, and other materials we publish (“ThinkwithAD Content”) are protected by copyright and other laws. Except where expressly allowed (e.g., brief quotations with attribution), you may not reproduce, distribute, or create derivative works from ThinkwithAD Content without prior written permission.

7) No Professional Advice

Content on the Service is for informational and educational purposes only and does not constitute legal, financial, investment, medical, or other professional advice. You are responsible for your own decisions.

8) Communications

By subscribing, you consent to receive emails from us. You can unsubscribe at any time via the footer link in each email. Some transactional emails (e.g., account, billing, or critical notices) may still be sent.

9) Third-Party Services & Links

We may link to or integrate third-party sites and tools. We do not control and are not responsible for third-party content, policies, or practices.

10) Changes to the Service

We may modify, suspend, or discontinue features at any time. We may also update these Terms. If changes are material, we’ll post an updated date or notice on the Service. Continued use after changes means you accept the revised Terms.

11) Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required by law. Sections that by nature should survive termination (e.g., IP, disclaimers, limitation of liability) will survive.

12) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14) Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your breach of these Terms.

15) Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of state and federal courts located in Charlottesville, Virginia for any dispute not subject to informal resolution.
